Terms of Service

1. Acceptance

By creating an account or using the Cut Time application, you agree to these terms. If you do not agree, do not use the service.

2. The service

Cut Time LLC, a Wyoming limited liability company (“Cut Time,” “we,” “us”), provides passive time tracking software for video editors and post-production studios. The service includes desktop tracker applications and a web dashboard. Cut Time's technology is patent pending.

3. Your account

You are responsible for keeping your account credentials secure. You must provide accurate information when creating your account. You may not share your account or invite codes with people outside your team.

4. Acceptable use

You agree not to:

  • Use the service to track individuals without their knowledge or consent
  • Attempt to reverse engineer, decompile, or tamper with the tracker application
  • Abuse the API or attempt to circumvent rate limits
  • Use the service for any unlawful purpose

5. Studio and workspace responsibilities

If you operate a studio or organization workspace on Cut Time, you are responsible for informing your editors that Cut Time is being used to track their editing time. Editors must be aware of and consent to being tracked before you add them to your workspace.

Studios are responsible for ensuring that their use of Cut Time complies with all applicable employment laws and regulations in their jurisdiction, including any requirements around employee monitoring or data collection. For workspace time data, the studio acts as the data controller and Cut Time processes that data on the studio's behalf; a data processing addendum is available on request at [email protected].

6. Intellectual property

The Cut Time software, design, branding, data visualizations, and all related intellectual property are the exclusive property of Cut Time LLC. You may not copy, modify, distribute, or create derivative works based on any part of the service without our written permission.

Your time tracking data belongs to you. We claim no ownership over the data you generate through your use of the service.

7. Software updates and beta features

The tracker application checks for and installs updates automatically, including silent background updates, so that all users stay on a current, supported version. By installing the tracker you consent to automatic updates. From time to time we may offer beta or preview features or builds to some accounts; these are provided as-is, may change or be withdrawn at any time, and may be offered before general release.

8. Your content

You may submit content to the service, such as a display name, avatar, bio, portfolio links, public profile details, and product reviews. You retain ownership of your content. You grant Cut Time a non-exclusive, worldwide, royalty-free license to host, display, and reproduce that content as needed to operate and promote the service. If you submit a review, you agree that we may display it publicly, including on our website and marketing materials, together with your name and your total tracked hours. You may request removal of a published review at any time by emailing [email protected]. Public profiles and portfolio pages are off by default and appear only if you enable them.

9. Data accuracy

Time tracking data is approximate and based on periodic polling intervals. Cut Time makes no guarantee that recorded times are perfectly precise. Factors such as system performance, network connectivity, and application behavior may affect the accuracy of tracked data. Time tracking data should be used as a reference and not as the sole basis for billing or compensation disputes.

10. Payment

New studio accounts begin with a 30-day free trial: unlimited editors, no credit card required to sign up. When the trial ends, studio dashboard access pauses until a subscription is started. Tracking continues and your data is retained, including hours recorded during that period, and becomes available again once the account subscribes. Studio subscriptions are billed per editor with no seat minimum.

Paid plans are billed monthly or annually, depending on the plan you choose. Payments are processed by Lemon Squeezy. You may cancel at any time - your access will continue until the end of the current billing period. We do not offer refunds for partial billing periods.

11. Availability

We aim to keep the service available at all times but make no guarantees. We may update, modify, or discontinue features with reasonable notice.

12. Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in abusive behavior, or use the service in a way that could harm other users or the integrity of the platform. We will make reasonable efforts to notify you before termination unless immediate action is required.

You may stop using the service at any time, and you may request deletion of your account and personal data by emailing [email protected]. We process verified deletion requests within 30 days, as described in our Privacy Policy.

13. Disclaimer of warranties

Cut Time is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that tracked data will be complete or precise (see Data accuracy above).

14. Limitation of liability

To the maximum extent permitted by law, Cut Time is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including lost revenue, data loss, or business interruption. Our total aggregate liability for all claims relating to the service is limited to the greater of one hundred US dollars ($100) or the amounts you paid to Cut Time in the twelve months before the event giving rise to the claim.

15. Indemnification

You agree to indemnify and hold Cut Time harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these terms, your content, or your use of the service in violation of law — including, for studio and organization accounts, any claim that you tracked a person without the notice or consent required in your jurisdiction.

16. Governing law

These terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

17. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify users via email or an in-app notice. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
